These terms apply when you use this website or order from Etchtone (sole proprietor) ("we", "us"). By placing an order you agree to them. They are written to comply with the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

1. Who we are

Etchtone is operated by Etchtone (sole proprietor), Bloemfontein, Free State, South Africa. Contact details, as required by section 43 of ECTA, are on the contact page.

2. Personalised products

Every plaque is manufactured to your specification from the photo, song and text you supply. You are responsible for checking the preview before you pay: spelling, cropping, the song chosen, and the size. We engrave exactly what the preview shows.

Because the goods are made to your specification and clearly personalised, the seven-day cooling-off right in section 44 of ECTA does not apply (section 42(2)(d)). Your rights for defective or damaged goods under the CPA are not affected. See the returns and refunds policy.

3. Your content

You confirm that you own or have permission to use any photo you upload and that it does not infringe anyone's rights, is not unlawful, and does not depict anyone in a way they would object to. We may refuse or cancel any order whose content we consider unlawful, hateful or otherwise unsuitable, and will refund it in full.

We use your photo and song details only to make and support your order. We do not use customer photos in marketing without your written permission. See the privacy policy.

4. Spotify codes

Spotify codes are generated by Spotify and scan with the Spotify app. Spotify is a trademark of Spotify AB; we are not affiliated with or endorsed by Spotify. If Spotify removes a track from its catalogue after your order, the code may stop working; we cannot control this and it is not a defect in the plaque.

5. Orders, prices and payment

All prices are in South African rand; we are not currently registered for VAT. An order is accepted when we confirm payment by email. Card and Instant EFT payments are processed by Yoco; we never see or store your card number. Manual EFT orders are reserved for 5 business days and cancelled if payment does not reflect. We may correct obvious pricing errors before accepting an order, in which case you may cancel for a full refund.

6. Delivery

Production and delivery times are set out in the delivery policy. They are estimates, not guarantees, but if we are more than 10 business days late through our own fault you may cancel for a full refund.

7. Limits on our liability

Nothing in these terms limits any right you have under the CPA. To the extent the law allows, our liability for any order is limited to the amount you paid for it, and we are not liable for indirect or consequential loss.

8. Intellectual property

The website, its design tools and content belong to us or our licensors. You keep the rights to your own photos and text.

9. Changes and law

We may update these terms; the version on the site when you order applies to that order. South African law governs these terms, and disputes may be referred to the National Consumer Commission or the courts of South Africa.
